§ 1
DATA CONTROLLER
The controller of your personal data is Marek Latuszek, doing business as Marketing Heroes Marek Latuszek, ul. Lipowa 1B, 55-040 Kobierzyce, Poland,
Tax ID (NIP): 8982174408, REGON: 367926919 (“MARKETING HEROES”).
For any data protection matters, please contact: contact@softaiconnect.com
.
This document sets out the rules for processing personal data obtained by MARKETING HEROES from users. Please read it carefully to understand our principles and procedures regarding data and its processing.
US context note: In the United States, there is no single federal consumer privacy law equivalent to the EU GDPR. Instead, privacy obligations arise from sector-specific federal laws (e.g., COPPA, HIPAA, GLBA) and an expanding set of state consumer privacy laws (e.g., California CCPA/CPRA, Virginia, Colorado, Connecticut, Utah, Texas, Florida, Oregon, etc.). If you reside in a U.S. state with a comprehensive privacy law, your rights and our duties may vary by state. See § 14 for a summary of rights commonly provided under U.S. state laws. (For background on CCPA/CPRA and the growing state-law patchwork, see official and practitioner overviews.

DATA PROTECTION OFFICER
MARKETING HEROES has not appointed a Data Protection Officer. For any issues related to your personal data, please contact MARKETING HEROES directly.
US context note: U.S. laws generally do not require appointing a Data Protection Officer, though some organizations voluntarily designate a privacy lead.
§ 3
PURPOSES AND LEGAL BASES FOR PROCESSING PERSONAL DATA
To enable your use of the www.softaiconnect.com
service (“softaiconnect.com”), MARKETING HEROES processes your personal data for the purposes listed below, together with the applicable legal bases.
Handling inquiries and responding: we process your name, phone number, and email address to receive and answer your requests. The legal basis is Article 6(1)(a) GDPR (your consent).
Marketing and remarketing: we process data collected through tools that track your actions on the site, namely:
Facebook Pixel,
Google Ads,
Google Analytics.
The legal basis is Article 6(1)(a) GDPR (your consent).
Newsletter (commercial information): we process your email address to send the newsletter. The legal basis is Article 6(1)(a) GDPR (your consent).
US context note: Under CCPA/CPRA and similar state laws, “sale” or “sharing” of personal information for cross-context behavioral advertising may trigger additional disclosures and a right to opt-out. We honor applicable state-law opt-out rights where required (see § 14). California law also requires specific notice language and, in some cases, a “Do Not Sell or Share My Personal Information” link.

§ 4
COOKIES
softaiconnect.com uses cookies—small text files stored on your computer, phone, tablet, or other device. This is similar to most websites. Cookies may be read by our systems and by third-party systems we use—Google (see § 5/§ 6) and Facebook (see § 7).
Information collected via cookies may include your IP address, browser type, language, operating system, internet service provider, time/date, location, and data submitted through contact forms.
Cookies serve various functions, such as:
Performance and usability: remembering your settings between visits to improve navigation.
Session status: storing information on how you use softaiconnect.com (e.g., most visited pages) and identifying errors to improve browsing comfort.
Statistics: analyzing how you use softaiconnect.com to personalize the site; we use Google Ads (§ 5), Google Analytics (§ 6), and Facebook Pixel (§ 7).
Social features: enabling you to like our fan page directly from the site.
Marketing: delivering more tailored offers (see § 8 for marketing cookies).
Many cookies are pseudonymous; without additional information, we cannot identify you.
Your browser likely allows cookies by default. On your first visit, we request your consent. If you prefer not to use cookies, change your browser settings to block them or to notify you whenever a cookie is stored. You can change settings at any time.
Disabling or restricting cookies may affect site functionality (e.g., repeated logins, inability to like our Facebook or Instagram page directly from the site).
You can also adjust cookie settings directly on softaiconnect.com under Cookie Settings.
US context note: Some U.S. state laws treat targeted advertising cookies as “sharing” or a form of processing that requires an opt-out mechanism. We provide applicable opt-out options where required (see § 14).

§ 5
GOOGLE ADS
Google Ads is provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Using Google Ads, we promote softaiconnect.com in search results and on third-party sites, based on our legitimate interest in marketing our products and services.
Visiting softaiconnect.com stores a Google remarketing cookie on your device that, via a pseudonymous identifier and your visited pages, enables interest-based ads.
Further processing via Google Ads occurs only if you have consented in your Google account to combine your browsing history/app usage with your account and to use that information to personalize ads.
If you are logged into Google while visiting softaiconnect.com, Google may combine your data with Google Ads data to create cross-device remarketing audiences.
International transfers: Google LLC is U.S.-based. For EU-U.S. data transfers, companies may rely on the EU-U.S. Data Privacy Framework (DPF), which replaced the invalidated Privacy Shield.

Google Analytics uses cookies stored on your device (e.g., laptop) to analyze your use of softaiconnect.com, measure campaign effectiveness, understand site usage, and optimize products/services.

The data mentioned above is transmitted to Google servers and stored there. Your browser-provided IP address is not combined with other Google data for this purpose.

§ 7
FACEBOOK PIXEL
Facebook Pixel is a marketing tool provided by Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA.
We use Facebook Pixel to deliver Facebook ads related to softaiconnect.com, based on our legitimate interest in marketing our products/services.
Facebook Pixel collects information about your use of softaiconnect.com (pages viewed, navigation paths, referral sources, time spent, demographic segments like age range/gender/interests inferred from online activity, approximate city-level location). These data are transmitted to and stored on Facebook servers in the U.S.
While the data we collect via Pixel are pseudonymous to us, Facebook may combine them with other data it holds about you and use them for its own purposes, including marketing.
International transfers: For EU-U.S. personal data transfers, the EU-U.S. Data Privacy Framework (DPF) now governs self-certified U.S. companies; Privacy Shield was invalidated in 2020 (Schrems II).

§ 8
PROFILING – MARKETING COOKIES
Pursuant to Article 13(2)(f) GDPR, we inform you that you are subject to profiling through the installation of marketing cookies on your device.
Under Article 4(4) GDPR, profiling means any automated processing of personal data to evaluate personal aspects (e.g., work performance, economic situation, health, preferences, interests, reliability, behavior, location, movements).
Our profiling is used solely for marketing—to provide you with more tailored offers that are more likely to interest you, including general ads, offers, or discounts related to MARKETING HEROES products/services aligned with your preferences.
You may object at any time to processing based on our legitimate interests, including processing for marketing and profiling.
Profiling does not result in decisions producing legal effects concerning you or similarly significantly affecting you.
If you want us to stop collecting information via marketing cookies, delete those cookies from your device. On your next visit to softaiconnect.com you may be asked again for your cookie preferences.
You can check/adjust Google ad personalization here: https://adssettings.google.com/authenticated
.
Marketing cookies are stored for up to 2 years from installation.
US context note: Many state laws give you a right to opt-out of targeted advertising (often called “sharing”). Where applicable, we honor such opt-out requests (see § 14).
oag.ca.gov
§ 9
RIGHT TO WITHDRAW CONSENT
Where processing is based on your consent, you may withdraw it at any time by:
emailing MARKETING HEROES at contact@softaiconnect.com
, or
sending a written statement to our postal address.
Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
US context note: Under U.S. state laws, certain processing may rely on “notice and opt-out” rather than consent; your opt-out rights are described in § 14.
oag.ca.gov
§ 10
OBLIGATION TO PROVIDE PERSONAL DATA
Providing personal data is voluntary, but in some cases necessary to use specific services:
Newsletter by email: we need your email address.
Inquiry handling: we need your email or phone number to respond.
Newsletter by SMS: we need your phone number.
Cookies: consent is required to avoid repeated logins and to enable social features (e.g., liking our Facebook page from the site).
§ 11
RECIPIENTS OF PERSONAL DATA
Like most businesses, we work with service providers. Where necessary, we may share your data with business partners such as:
BLUE MEDIA S.A. (payment services)
PAYPRO S.A. (payment services)
KRAJOWY INTEGRATOR PŁATNOŚCI S.A. (payment services)
In the future, circumstances may arise requiring disclosure of personal data. Each such case will be carefully assessed to prevent disclosure to unauthorized parties.
US context note: Where U.S. state laws distinguish “service providers” / “processors” from “third parties,” we contractually restrict service-provider uses of personal information as required. Disclosures qualifying as a “sale” or “sharing” will be handled in line with state-law opt-out rights (see § 14).
oag.ca.gov
§ 11a – STRIPE PAYMENTS
For payment processing, we use Stripe Payments Europe, Ltd. (or the relevant Stripe entity depending on the User’s location). Stripe may process personal data such as name, email address, payment card details, and IP address for the purposes of completing transactions, preventing fraud, and complying with legal obligations. For more details, please refer to Stripe’s Privacy Policy: https://stripe.com/privacy
§ 12
TRANSFERS OF PERSONAL DATA TO THIRD COUNTRIES
MARKETING HEROES informs you that your personal data are not transferred outside the European Economic Area.
US context note: If we later transfer EU/UK personal data to the U.S., we will use a valid transfer mechanism—typically the EU-U.S. Data Privacy Framework (DPF) for certified U.S. recipients or the European Commission’s Standard Contractual Clauses with appropriate supplementary measures. (DPF replaced Privacy Shield after Schrems II.)

§ 13
DATA RETENTION
We process your data only as long as necessary for the stated purposes, after which it is irreversibly deleted.
Specifically, email addresses and phone numbers used for newsletters are processed until consent is withdrawn. We may contact you to reconfirm consent after a period.
For operational efficiency, we count retention periods from the end of the calendar year in which processing began. Requests to exercise the right to be forgotten are assessed individually.
US context note: Several U.S. state laws require data-minimization and retention-limitation practices. We apply those where applicable to your jurisdiction.

§ 14
DATA SUBJECT RIGHTS
You have the right to:
Access your personal data. You can ask what we process and from what sources. In some cases, you may receive a copy in a commonly used, machine-readable format or request data portability to a third party.
Rectification of inaccurate or incomplete data.
Erasure (“right to be forgotten”), subject to legal exceptions (e.g., defense of claims).
Restriction of processing where data are no longer necessary for the purpose.
Objection to processing based on our legitimate interests, including marketing and profiling.
Data portability in applicable cases.
We respect your rights and will facilitate their exercise. These rights are not absolute; where the law allows, we may refuse after careful analysis (e.g., overriding legitimate grounds or legal claims).
You may always object to marketing uses of your data; we will stop such processing.
You can exercise your rights by emailing contact@softaiconnect.com
or by sending a written statement to our postal address.
US context note: Depending on your state, you may have rights to know/access, correct, delete, opt-out of sale/sharing/targeted advertising, limit use of sensitive data, and data portability. California residents also have rights regarding “sharing” for cross-context behavioral advertising and may use an authorized agent; businesses must provide at least two submission methods and respond within set timelines. We honor these rights where applicable and do not discriminate for exercising them. (See official CCPA/CPRA resources and state-law trackers for current coverage.)
